1. Introduction

These Terms and Conditions ("Terms") govern your access to and use of the Vunessak Casino Hotel facilities, services, website, and mobile applications (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.

Please read these Terms carefully before using our casino and hotel resort Services. If you do not agree to these Terms, you may not access or use our Services.

2. Eligibility

You must be at least 21 years of age to enter our casino hotel facilities, register for an account, or use our Services. By accessing or using our Services, you represent and warrant that you are at least 21 years old.

We reserve the right to request proof of age at any time, and to refuse service to anyone who cannot provide valid identification proving they are at least 21 years of age.

3. Reservations and Cancellations

3.1 Reservations

All reservations at our casino and hotel resort are subject to availability and require a valid credit card to guarantee the reservation. Room rates are per room, per night, based on single or double occupancy, and exclude taxes and resort fees, unless otherwise indicated.

3.2 Check-In/Check-Out

Check-in time is 3:00 PM. Check-out time is 11:00 AM. Early check-in and late check-out requests are subject to availability and may incur additional fees.

3.3 Cancellations and No-Shows

Cancellations must be made at least 48 hours prior to the scheduled arrival date to avoid a cancellation fee equal to one night's stay plus applicable taxes. No-shows will be charged the full amount of the reservation.

3.4 Group Reservations

Reservations for groups of 10 or more rooms are subject to separate terms and conditions, which will be provided at the time of booking.

4. Casino Rules

Use of our casino facilities is subject to the following rules:

• All guests must be 21 years of age or older to enter the casino area or participate in any gaming activities.
• Valid government-issued photo identification is required for entry and may be requested at any time.
• The casino and hotel resort reserves the right to refuse service to anyone for any reason in accordance with applicable laws.
• Guests are expected to conduct themselves in a responsible manner at all times.
• Photography, video recording, and use of mobile phones at gaming tables are prohibited.
• Management reserves the right to resolve all disputes regarding game play, promotions, and rewards.

5. Industrial Heritage Area Rules

As a historic converted industrial building, our casino hotel has specific rules regarding the preserved industrial elements:

• Do not touch, climb on, or attempt to operate any preserved industrial machinery or equipment.
• Stay within designated guest areas at all times.
• Follow all posted signage regarding restricted areas and preservation notices.
• Flash photography is prohibited near certain historic machinery displays.
• Guided access to certain industrial areas is only available through official tours.

6. Code of Conduct

All guests of our casino and hotel resort are expected to adhere to the following code of conduct:

• Treat all staff members and other guests with respect and courtesy.
• Refrain from using offensive language or engaging in disruptive behavior.
• Do not engage in any illegal activities on the premises.
• Dress appropriately in all public areas.
• Smoking is only permitted in designated areas.
• Pets are not allowed, with the exception of service animals.
• Observe and comply with all posted safety regulations and emergency procedures.

Violation of our code of conduct may result in removal from the premises without refund.

7. Damage to Property

You are responsible for any damage to our casino hotel property caused by you or your guests. We reserve the right to charge your credit card or bill you for any repairs, replacements, or special cleaning required as a result of such damage.

Given the historical significance of many elements in our building, intentional damage to preserved industrial features may result in additional penalties.

8. Limitation of Liability

To the maximum extent permitted by law, Vunessak Casino Hotel and its affiliates, officers, directors, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use our Services;
• Any conduct or content of any third party on our Services;
• Any content obtained from our Services; and
• Unauthorized access, use or alteration of your transmissions or content.

9. Indemnification

You agree to indemnify, defend, and hold harmless Vunessak Casino Hotel and its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) that such parties may incur as a result of or arising from your violation of these Terms.

10. Modifications to Terms

We reserve the right to modify these Terms at any time. All changes are effective immediately when posted. Your continued use of our Services following the posting of revised Terms means you accept and agree to the changes.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions.
